Terms and Conditions

These conditions govern access to and use of the website of the Living Canedo development. By using the site, the user accepts them. If you do not agree with them, you should refrain from using it.

This page is an English translation of the Portuguese original, provided for convenience. In the event of any divergence between the two texts, the Portuguese version is the binding one and prevails. You can read it here: Termos e Condições.

1. Purpose of the site

The site is a means of presenting and promoting the Living Canedo property development, in Canedo, Santa Maria da Feira. It is exclusively informative and promotional in nature: it describes the development, shows images and gives the contact details for anyone who wants to know more or to arrange a viewing.

The site is not a shop and does not allow any transaction to be concluded online. It publishes no prices, takes no reservations, accepts no payments and does not allow any service to be subscribed to.

2. Entity responsible for the site

The site is the responsibility of Impacto Monumental, Unipessoal Lda, a sociedade unipessoal (single-shareholder private limited company) with registered office at Rua de Gassamar, n.º 651, 4415-822 Vila Nova de Gaia, Porto, single registration and legal person number 518624960 and share capital of € 10.000,00, which carries on the business of real estate mediation under the Douven brand. The same details appear in point 1 of the Privacy Policy.

In the site's closing block, under the words "Brought to you by", two entities are identified: Douven & Co, as the agency, and Clever Option, as the entity promoting the development. Promotion of the development belongs to Cleveroption - Construções, Sic Imobiliária Fechada, S.A, with registered office at Edifício Tower Plaza, Via Engenheiro Edgar Cardoso, 23, 5.º D, 4400-676 Vila Nova de Gaia and single registration and legal person number 509396003.

As regards the visitor to the site, the roles are divided as follows: mediation of the development is carried out by Impacto Monumental, Unipessoal Lda, under licence AMI 26397 referred to in point 7, and promotion of the development belongs to Cleveroption - Construções, Sic Imobiliária Fechada, S.A. The site is informative in nature and does not, by itself, bind either of these entities: the binding elements of any transaction are those set out in the contractual documents of each unit, under point 3.

3. Nature of the information published

All information published on the site is informative in character and constitutes neither a contractual proposal, nor a binding offer, nor a promise to contract. The binding elements of any transaction are exclusively those set out in the contractual documents and in the official documentation of each unit.

The images are renders. Areas and typologies are set out in the price list and in each unit's documents. Listings are indicative and subject to change by the developer.

To the same effect, the list of finishes presented on the site is accompanied by the following note:

This list is indicative and may be changed by the developer, keeping the same standards of quality.

Specifically, and in the terms of the notice above: the images on the site are renders, illustrative images, not photographs of a building that has been built; the areas and typologies are those set out in the price list and in the unit's documents; and the information about phases and schedule published on the site ("Start: 2026 · Expected completion: 2028 · Sales under way") corresponds to a forecast and to the position as at the date it was published. All of this is indicative in nature and subject to change by the developer.

4. Intellectual property

The site's content (texts, images, renders, trade marks, logos, graphic design and code) is protected by copyright and related rights and by industrial property rights, and belongs to the entity responsible for the site or to third parties who authorised its use.

Consultation and reproduction for personal, non-commercial use are permitted. Without prior written authorisation, the reproduction, distribution, communication to the public, transformation or any other use of the content, in whole or in part, for commercial or promotional purposes is prohibited, as is the systematic extraction of content from the site.

5. Use of the site

The user undertakes to use the site in accordance with the law and with these conditions, refraining from any conduct that may damage, overload or impede the normal operation of the site, compromise its security or improperly access systems or data.

6. Limitation of liability

The entity responsible for the site seeks to keep the information published on it correct and up to date, but does not guarantee that it is free of slips, omissions or out-of-date material, nor that the site is permanently available and free of errors or interruptions, which may arise from maintenance operations, technical failures or causes beyond its control.

To the extent permitted by law, liability is excluded for damage resulting from access to or the impossibility of accessing the site, as well as from decisions taken exclusively on the basis of the information published on it, without consulting the official documentation of each unit. This limitation does not set aside any liability that the law imperatively establishes, namely towards consumers.

7. Real estate mediation

The marketing of the development is accompanied by real estate mediation activity, carried on under licence AMI 26397, stated on the site. The holder of this licence is Impacto Monumental, Unipessoal Lda, identified in point 2.

Real estate mediation activity is required to make a complaints book available (article 20.º of Lei n.º 15/2013, de 8 de fevereiro). The Livro de Reclamações Eletrónico, the Portuguese electronic complaints book, is available at www.livroreclamacoes.pt.

If you are a consumer, you may also have recourse to alternative dispute resolution for consumer disputes, under Lei n.º 144/2015, de 8 de setembro.

8. Links to third-party services

The site contains links that open third-party services, namely WhatsApp, from the viewing booking button, and the email and telephone applications on the user's device. Those links exist to make contact easier and do not imply any association with those services or control over them: once outside the site, the terms and policies of those entities apply.

9. Data protection and browser storage

The processing of personal data is described in the Privacy Policy; what the site stores in the user's browser is described on the Cookies and Storage page. Both form an integral part of these conditions.

10. Applicable law and forum

These conditions are governed by Portuguese law. No conventional forum is stipulated: the court determined by law has jurisdiction to resolve any dispute arising from use of the site, with the mandatory rules of consumer protection remaining fully applicable.
